What Is An Arbitrated Divorce?
An alternative to a traditionally litigated divorce proceeding is an arbitrated divorce. Arbitration can be a cost effective way to dissolve a marriage and minimize conflict by settling areas of contention and dispute in a less formal setting than a courtroom with traditional rules of presenting evidence and testimony.

An Arbitrator is mutually selected and agreed upon to hear a case, consider evidence and issues and then propose a settlement. The arbitration process is voluntary and requires mutual consent from both parties in a divorce.

Arbitration is conducted with approval from the Family Court and is subject to review by the Court. Arbitration can be binding or non-binding and hearings are held in private outside of the courts at times that are convenient to all parties and their counsel, you do not have to conform to the court's schedule and the time contraints. Arbitrator's fees and expenses are negotiable and are shared between the parties.
